TikTok Fights Back
TikTok is suing the state of Montana, claiming that their ban on the app goes against its First Amendment rights since it limits the hosting and distribution of user-generated content. TikTok is objecting to Montana’s attempt to regulate national security matters, saying it should be handled by federal regulators. This could complicate TikTok’s ability to operate in other states.
A spokesperson representing TikTok told TechCrunch “We are challenging Montana’s unconstitutional TikTok ban to protect our business and the hundreds of thousands of TikTok users in Montana. We believe our legal challenge will prevail based on an exceedingly strong set of precedents and facts.”.
If TikTok’s request is approved by the court, the app can still work in Montana while the legal disputes are dealt with.
