A lawsuit against Meta that had been brewing for almost a year and a half was dismissed last week by a judge in the U.S. District Court for the Eastern District of New York.

Phhhoto filed action against Meta in late 2021, claiming that the company broke federal antitrust law by plagiarizing some of Phhhoto’s main functionalities for use in its own Instagram-related video looping tool, Boomerang. U.S. District Judge Kiyo Matsumoto agreed with Meta that it was too late to file suit and dismissed the case.
Mark Zuckerberg, CEO of Meta, downloaded Phhhoto, and Kevin Systrom, co-founder of Instagram, checked it out. Facebook started talking to the Phhhoto staff, but nothing came of it. In 2017, Phhhoto had already vanished.
